General Conditions of Sale (GCS) - SUBELVA
Article 1 - Scope of application
These General Conditions of Sale (GCS) govern all sales of products made by Samantha AVRIL LOHYAC, operating under the trade name SUBELVA, registered under SIREN 939 268 983 and SIRET 93926898300011, via its website www.subelva.fr .
Article 2 - Products and services
SUBELVA offers handcrafted, custom, and printed products on various materials (mugs, water bottles, textiles, etc.) using sublimation, heat transfer, and other printing techniques. Products are sold as is, with no possibility of modification after order confirmation.
Article 3 - Orders
Any order placed on the website www.subelva.fr implies full acceptance of these General Terms and Conditions. Once payment is confirmed, the order becomes final and cannot be modified or canceled, unless otherwise provided by law.
Article 4 - Rates and payment
Product prices are listed in euros (€) inclusive of all taxes (TTC) and may be changed at any time. However, the price applied is the one displayed at the time of order validation.
Payment is made exclusively by credit card (Visa, Mastercard, American Express) and Apple Pay via a secure platform. Other payment methods may be offered from time to time and will be indicated on the website.
Article 5 - Delivery
Orders are delivered in mainland France within an average of 7 working days from payment confirmation. These delivery times are given as an indication and may be affected by logistical constraints or force majeure.
SUBELVA cannot be held responsible for delivery delays attributable to carriers. In the event of non-receipt, the buyer is invited to contact customer service at contact@subelva.fr .
Article 6 - Right of withdrawal and returns
In accordance with Article L.221-18 of the Consumer Code, the buyer has a period of 14 calendar days from receipt of the order to exercise his right of withdrawal.
🚨 Exception: Personalized products cannot be returned or exchanged, except in the event of a manufacturing defect or SUBELVA error.
To exercise their right of withdrawal, the buyer must send an email to contact@subelva.fr specifying their order number and returning the product in perfect condition, at their own expense.
Article 7 - Liability
SUBELVA cannot be held liable for any direct or indirect damage resulting from improper use of the products. The buyer is required to carefully read the usage recommendations provided with the items.
SUBELVA declines all responsibility in the event of force majeure (strike, bad weather, pandemic, etc.).
Article 8 - Protection of personal data
Information collected during orders is processed in accordance with the General Data Protection Regulation (GDPR).
The buyer has the right to access, rectify and delete their data upon simple request to contact@subelva.fr . No personal data will be sold or transmitted to third parties without prior consent.
Article 9 - Disputes and applicable law
These General Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority.
In the absence of an agreement, the dispute will be submitted to the competent courts of the defendant's domicile or the place of delivery of the product.
